Is It Legal to Buy Psilocybin Mushroom Spores in the United States?

As soon as spores begin to germinate into mycelium, law enforcement can legally charge you with cultivation or possession of a controlled substance. The same goes for the possession or sale of fresh and dried psilocybin mushrooms.

If you live in other parts of the world or intend on traveling, you should check into local laws on psilocybin. In some countries, like Indonesia, possessing psilocybin spores is punishable by death, while other more lenient countries like Samoa, they are legal to cultivate.

Your best bet for purchasing psilocybin mushrooms spores for educational and research purposes is online. Only three cities in the United States have decriminalized magic mushrooms; Oakland, Santa Cruz, and Denver. Oakland and Santa Cruz are both in California which has a state ban on selling the spores, so buying them in person is likely more trouble than it’s worth.
