What is the PACT Act?
The Prevent All Cigarette Trafficking (PACT) Act was intended to prevent illegal tobacco sales, tax avoidance, and the shipping of cigarettes and smokeless tobacco products directly to consumers via the United States Postal Service (USPS).
The 2021 PACT Amendment
As part of the COVID-19 stimulus relief legislation signed into law in December 2020, the PACT Act was amended to now include electronic nicotine delivery systems (ENDS). Under the amendment, vape companies appear to be prohibited from shipping vaping products via USPS. All major U.S. parcel carriers (UPS, FedEx, DHL, etc.) have also agreed to honor the PACT Act and prohibit shipping vaporizer components via their services.
An ENDS product is defined by the law as “any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device [including] an e-cigarette; an e-hookah; an e-cigar; a vape pen…and any component, liquid, part or accessory of a device…without regard to whether the component, liquid, part, or accessory is sold separately from the device.”
How will this impact Jupiter and our customers?
Jupiter will continue to have methods of shipping, but there will be immediate changes:
Changes apply to the continental U.S., including Hawaii, Alaska, and Puerto Rico.
Minimum Order Quantity for free freight shipping: 10k cartridges with mouthpieces (or equivalent weight of devices, all-in-ones, pods, etc).
An order of less than the MOQ volume will be subject to a $150 freight surcharge.
No access to expedited freight (next day air, 2-day air, 3-day guaranteed, etc).
Order pickup at Jupiter headquarters in Phoenix, AZ will continue to be available to all customers.
Has this change gone into effect yet?
No. The current date set for these changes to go into effect is Friday, April 2, 2021. If you would like to adjust the quantities of any orders before the change is implemented, reach out to your Jupiter Account Executive ASAP.
What can I do about this potential change?
The PACT Act is under further review and any changes to the ruling will be announced on Monday, April 26, 2021. Many groups and coalitions, including the Cannabis Voter Project, are demanding adjustments to these regulations and limit restrictions on the vape industry as a whole.
